Trump says six lawmakers committed “SEDITIOUS BEHAVIOR, punishable by DEATH” after they told troops to refuse illegal orders
Trump described a November 2025 video by six Democratic lawmakers as “SEDITIOUS BEHAVIOR, punishable by DEATH.” The federal seditious-conspiracy statute carries up to 20 years in prison, not death. A different statute addressing efforts to cause military insubordination carries up to 10 years. Treason can carry death, but it is a distinct constitutional/statutory offense. In February 2026 a D.C. grand jury declined prosecutors’ request to indict the six lawmakers, and on August 25 a watchdog filed bar complaints against U.S. Attorney Jeanine Pirro and two deputies over the failed prosecution effort. The grand-jury refusal is not an acquittal and the bar complaints are allegations, but neither supplies support for Trump’s death-penalty characterization.
